Current Rule Making

Display of Flags on the Capitol Campus

Chapter 200-240 governs where flags may be displayed on the state Capitol Campus and who may allow flags other than the United States flag and the Washington State flags to be flown.

Rules were first adopted in 1976 and are no longer in alignment with current law and practice. This update is needed to clarify that other flags may be flown and to clarify that the borders of the state capitol campus are those designated by law.

Design and construction standards of sidewalk and curb ramps

Chapter 200-340 puts in place model standards for constructing curb ramps to allow reasonable access to the crosswalk for physically handicapped persons without uniquely endangering blind persons. These rules apply to counties, cities, and towns.

Rules were first adopted in 1978 and are no longer in alignment under the current State Building Code. This update is needed to align the standards with current State Building Code requirements and to improve access to the crosswalk for physically handicapped persons without uniquely endangering blind persons.

The Competitive Contracting Bid Process

The former Department of General Administration was eliminated in 2011with the formation of the Department of Enterprise Services. In addition, changes have been made to RCW 41.06.142 Competitive Contracting since the competitive contracting bid process rules were adopted. Because of this, DES will be updating the rules to align with the current statutes.

In addition, DES will consider aligning where feasible, parts of the competitive bidding processes under RCW 41.06.142 with similar statewide contracting processes enacted under Procurement Reform (chapter 39.26 RCW)

Credit, Charge or Purchasing Cards 

Under HB 2452 (2012), commonly known as Procurement Reform, RCW 43.19.185 was repealed. RCW 43.19.185 mandated the development of credit card systems and rules relating to the use of credit cards by state agencies and departments.

While the development of credit card policies and standards are required under HB 2452, credit card rules are no longer required.

In addition, fully developed and operational credit card systems, controls and policies are in place and widely used and followed by state agencies and departments.

Because of this, chapter 200-370 is no longer relevant.

Public Records

Changes to DES's public records rules are needed to clearly identify public records requests to make sure DES meets the statutory response timeframes under RCW 42.56.520. Additional rules may be needed to align with recent legislation.

Managing State Print Operations 

This rule making activity is needed to put requirements and guidance in place for state agencies to use in managing their printing operations. Print operations includes agency-based printing and print jobs that require the services of a print shop.

In addition, rules are needed to implement managed print strategies to track, manage, and reduce agency-based printing.

Employee Training and Development

This rule making activity is necessary to align state personnel training rules with current circumstances and to correct errors.

WAC 200-600-030 requires agencies to report to the department of enterprise services their compliance with sexual harassment awareness and prevention training requirements under WAC 357-34-100 and 357-34-105. WAC 200-600-030 rule is no longer needed because a system is in place that automatically captures relevant state agency training information and is capable of providing reports sufficient to comply with the requirements. This system is known as the Learning Management System (LMS) and is managed by DES.

Procurement Reform 

Under HB 2452 (2012), laws relating to the procurement of goods and services were reorganized and recodified into a new chapter in Title 39 RCW. The processes for procurement of personal services contracts, or services, were combined with the processes for procurement of goods.

As a direct result of the passage of HB 2452, sections of chapters 200-300 and 200-310 are invalid or are no longer relevant. This rule change consolidates and aligns the remaining sections with current law and statewide procurement policy.
